When conducting any procurement procedure, the Company selects a party (legal entity or individual entrepreneur) as a preferred participant to agree on the essential and other terms of the relevant procurement contract for its subsequent conclusion.

All costs for the preparation and submission of the necessary documents for participation in the procurement procedure shall be borne by the bidder. The Company has no obligation to reimburse the Bidders for the costs incurred and other expenses associated with the preparation and participation in the procurement procedure (actual losses), as well as for lost profits, regardless of the outcome of the procurement procedure.

The preferred participant bears all costs associated with the negotiation with the Company of the essential and other terms of the relevant contract, and the Company has no obligation to reimburse the preferred participant for the costs incurred and other costs associated with the negotiations and lost profits, regardless of the outcome of the negotiations.

If the Company does not agree to the terms of the contract, it has the right not to enter into a contract with the preferred bidder. The Company has the right to suspend the procurement, negotiations and conclusion of the contract at any stage by sending a notice to the bidders or the preferred bidder.

In 2022, the Company`s purchasing departments were tasked with reducing the number of non-specialized intermediaries, both when purchasing in bulk and when purchasing individual materials. The Company reserves the right to pay closer attention to contractors that are not manufacturers or their sales divisions.
